EnviroAnalytics LLC ("EnviroAnalytics", "we", or "us") recognizes the importance of privacy. In this Privacy Policy, we describe how we collect, use, and disclose information that we obtain about users of our website, located at www.enviro-analytics.com and any associated websites linked thereto by EnviroAnalytics (including, without limitation, any linked API URLs) (collectively, the "Site") or via any online or downloadable software application available via the Site or directly from EnviroAnalytics (collectively, the "Application"), and the services EnviroAnalytics provides via the Application (collectively, the Site, the Application and such services, the "Service").

Your use of the Service, and any dispute over privacy, is subject to this Privacy Policy and any other applicable agreements between you and EnviroAnalytics, such as our Customer Terms of Service (the "Customer Terms"), our User Terms of Use & Service (the "User Terms"), or our Website Terms of Use ("Website Terms"), including any applicable limitations on damages and the resolution of disputes provided therein. By using any part of the Service, you agree that any information we collect from or about you through the Service, including personal information, anonymous information, and aggregated information, will be handled as described in this Privacy Policy. If you do not agree with any term set forth in this Privacy Policy, do not access or use the Service.

Definitions

Capitalized terms used but not otherwise defined in this Privacy Policy have the respective meanings given to such terms in the Customer Terms, the User Terms, or the Website Terms, as applicable.

Information We Collect

We collect information about you directly from you, from third parties, and automatically through your use of the Service. We may combine information collected from or about you through any of these various sources.

Information We Collect Directly From You. We may collect information about you directly from you. For example, if you create a User Account with us, we will collect your name and e-mail address; if you purchase a Project Report from us, whether on your own behalf or on behalf of a Customer, we may need to collect your name, credit card information, and billing address. We will also collect any other information that you provide to us through the Service, such as your contact information, occupation, company, industry, and demographic information.

Information We Collect About You from Third Parties. We may also collect information about you from third parties. For example, if you log in to your User Account using your account credentials for a Third-Party Site (e.g., Linkedin), we will collect your account credentials for your account with such Third-Party Site, and you are granting us access to personal profile fields stored by such Third-Party Site. In addition, we may request access to other information stored with such Third-Party Site, such as your contacts. We store the information that we receive from Third-Party Sites with other information that we collect from you or receive about you, but the applicable Third-Party Site controls the information it collects from you. We have no control over how any third party uses or discloses the information it collects about you, and you acknowledge that it is your responsibility to review and understand the respective privacy policies of any such Third-Party Sites.

Information We Collect Automatically Through Our Service. We automatically collect information about you through your use of the Service, including, without limitation your IP address, browser type, domain name, the website that led you to the Service, the website to which you go after leaving the Service, the dates and times you access the Service, and the links you click and your other activities within the Service. Please see our "Cookies" and "Other Tracking Mechanisms" section below for more information. We may combine information we collect automatically with information we collect directly from you or from third parties.

Location and Geolocation Information. We may infer information about your location from the information that you provide to us directly or from your IP address. We may also obtain geolocation information about you (e.g., through a third-party application that tracks GPS coordinates). We use geolocation information to, for example, improve the quality of data available in the Service and/or provide you with better context for the geospatial features around you. You can disable our access to your geolocation services by disabling location sharing in your browser or device settings. Doing so, however, will limit your ability to use certain features of the Service (e.g., perspective/in-the-field views of your Projects and Project Reports).

User Submissions

We invite you to post content to the Service (referred to as "User Submissions"). You acknowledge that any of your User Submissions will be available to other users with whom you or a Customer shares those User Submissions. Please note that we cannot prevent other users from using such information in a manner that may violate this Privacy Policy, our Customer Terms, the User Terms, the Website Terms, applicable law, or your personal privacy.

You acknowledge that, if you created a User Account after being invited to the Service by an organization (e.g., your employer or another entity or person) that entered into the Customer Terms ("Customer"), any User Submissions you provide through that User Account will be owned and controlled by that Customer (as set forth in the User Terms). If you have any questions about specific privacy settings within a Customer Account in connection with which you are accessing the Service, please contact the Customer, if applicable.

How We Use Your Information

We may use your information, including personal information, for the following purposes.

Providing and Improving Our Service. To provide and maintain the Service; to improve the Service; to develop new features, products, or services; to perform technical operations, such as updating software; and for other customer service and support purposes.

Marketing and Communications. To communicate with you about your account and use of the Service, including to send you product updates; to respond to your inquiries and complaints; to provide you with news and newsletters, special offers, promotions, and other information we think may interest you; and for other informational, marketing, or promotional purposes. Our communications with you may include communications via e-mail. Please see the section "Your Choices" below for more information about how to change your communications preferences.

Research and Analytics. To analyze how you interact with the Service; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes.

Protecting Rights and Interests. To protect the safety, rights, property, or security of EnviroAnalytics, the Service, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity which EnviroAnalytics, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy or our Customer Terms, User Terms or Website Terms.

Legal Compliance. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.

How We Disclose Your Information

We may disclose your information, including personal information, as described to you at the time of collection or disclosure or as follows:

EnviroAnalytics Users. We may disclose your information to other users of the Service, if you choose to share such information with other users. For example, if you share an Analytics Report with a colleague, that colleague will be able to view the Analytics Report and any Report Comments or Report Notes that you may have made to the Analytics Report.

Affiliates. We may disclose your information to current or future affiliates or subsidiaries for research, marketing, and other purposes consistent with this Privacy Policy.

Service Providers. We may disclose your information to our vendors, service providers, agents, or others who perform functions on our behalf. For example, we may disclose your information to third-party service providers to process payments on our behalf.

Business Transfers. We may disclose your information to another entity in connection with, including during negotiations of, an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer.

Protecting Rights and Interests. We may disclose your information to protect the safety, rights, property, or security of EnviroAnalytics, the Service, any third party, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity which EnviroAnalytics, in its sole discretion, may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; and to enforce this Privacy Policy or our Customer Terms, User Terms or Website Terms.

Legal Compliance. Cookies and Other Tracking Mechanisms

We and our service providers use cookies and other tracking mechanisms to track information about your use of the Service. We or our service providers may combine this information with other information, including personal information, we collect about you.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate the Service, while others are used to enable a faster log-in process or to allow us to track your activities while using the Service. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to the Service who disable cookies will be able to browse certain areas of the Service, but some features may not function (e.g., you may not be able to stay logged into your account).

Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer's hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also referred to as web beacons, web bugs or pixel tags), in connection with the Service to, among other things, track the activities of users of the Service, help us manage content, and compile statistics about usage of the Service. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Payment Information & Processing

In connection with any fees due to us for your use of the Service, we may collect credit card or additional payment information from you. It is important to note, however, that we do not store any of this payment information or process any of your payments on our servers. Instead, we use a third-party payment service known as Stripe. Therefore, any information regarding your payment processing and security must be verified in Stripe's own Terms of Service Agreement and Privacy Policy.

The payment processor Stripe may provide us with unique authentication tokens to make payments requests with and may also provide us with information such as your name, credit card type, expiration date, and the last four digits of your credit card number. This information is used only to make single payment requests, or to register you for an ongoing Subscription that requires automatic payments in the future. Our third-party payment processors are bound by contractual obligations to keep such Personal Information confidential and use it only for the purposes for which we disclose it to them. However, we are not responsible for any third-party payment processor's use of the Personal Information they collect in connection with your financial transactions made via the Service.

Third-Party Analytics

We may use third-party analytics companies to evaluate use of the Service. We or our service providers use these tools to help us understand use of, and to improve, the Service, performance, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services. Such analytics companies include Google Analytics. Do Not Track Disclosure

Our Service does not respond to Do Not Track signals. For more information about Do Not Track signals, please click here. You may, however, disable certain tracking as discussed in the Cookies and Other Tracking Mechanisms section above (e.g., by disabling cookies). You also may opt out of targeted advertising by following the instructions in the Interest-Based Advertising section below.

Interest-Based Advertising

We use third parties such as network advertisers to serve advertisements on the Service and on third-party websites or other media (e.g., social networking platforms). This enables us and these third parties to target advertisements to you for products and services in which you might be interested. Users in the United States may opt out of many third-party ad networks. For example, you may go to the Digital Advertising Alliance ("DAA") Consumer Choice Page for information about opting out of interest-based advertising and your choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative ("NAI") Consumer Opt-Out Page for information about opting out of interest-based advertising and your choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies' delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Third-Party Sites & Services

Our Service may contain links to Third-Party Sites and may integrate with certain Third-Party Services. Any access to or use of such Third-Party Sites or Third-Party Services is not governed by this Privacy Policy but instead is governed by the privacy policies of the respective third-party owners and operators thereof. We are not responsible for the information practices of such third parties.

Security

We have taken steps to help protect the personal information we collect. However, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your device and account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Your Choices

Accessing, Modifying, or Deleting Your Personal Information. You may access, modify, or delete the personal information that you have provided to us by logging into your account settings. Please note that we may retain certain information about you as required by law or as permitted by law for legitimate business purposes (e.g., in accordance with our record retention policies). For example, if you request that we delete your information but we believe that you have violated our Customer Terms, User Terms or Website Terms, we may retain information about you in order to attempt to resolve the issue before deleting it.

Opting out of Marketing Emails. We may send periodic promotional e-mails to you. You may opt out of such communications by following the opt-out instructions contained in the e-mail or e-mailing us at info@enviro-analytics.com Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving e-mails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Service you have requested or received from us.

Children

You must be at least eighteen (18) years of age to use the Service. Our Service is not targeted to children under thirteen (13) years of age and we do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete such personal information from our systems.
